What are Examples of Gender Discrimination in the Workplace?

Recognizing gender discrimination has not always been easy, even in the early days of those laws that primarily focused on the rights of women in the workplace. It is even more complex today, affecting a greater number of men and those in the LGBTQ+ community.

Existing law prohibits workplace discrimination against workers who were assigned a male or female gender at birth. This law also requires that employers consider transgender identity and expression. Gender identity is how the person identifies, regardless of their assigned sex at birth or how they look. Gender expression refers to someone’s gender-related appearance or behavior.

It can be hard to identify, and sometimes even harder to prove in a court of law. To find out if you have been the victim of gender discrimination in the workplace, it is helpful to review some examples of this illegal behavior.

Examples of Workplace Gender Discrimination

You may be experiencing gender discrimination in the workplace if you experience one of the following:

  • Didn’t get hired for a job, or got a lower-paying position, because of your assigned gender, gender identity, sexual orientation, or because you do not behave in ways that conform to traditional views of gender roles
  • Are held to a higher standard or are evaluated more harshly because of your assigned gender, gender identity, or sexual orientation
  • Are receiving less pay than someone of a different gender or sexual orientation who has similar (or fewer) qualifications or job duties than you
  • Have been or are being denied a pay raise, promotion, or training opportunity that someone of another gender, gender identity, or sexual orientation who is equally or less qualified than you
  • Being “written up” or otherwise disciplined for doing something that other workers of a different gender or gender identity do without punishment
  • Are called slurs or derogatory names, being insulted, or hearing derogatory remarks about people of a certain sexual orientation or gender identity
  • Being repeatedly or intentionally called by a different name than you prefer, or by being referred to as a gender different than the one you don’t identify with; examples include calling a transgender person by their “dead name,” or being referred to as “Miss” when you prefer “Mister”
  • Are the target of requests for sexual favors, unwelcome sexual remarks or advances, or other physical/verbal harassment of a sexual nature
  • Have been forced to take leave, rejected for a job, or been given fewer assignments because you are pregnant
